1. Who we are

This website is operated by Gate Wall Studios LLC, a Wyoming limited liability company, 1021 E Lincolnway, Suite 10442, Cheyenne, WY 82001, United States. In these terms "we", "us" and "our" mean Gate Wall Studios LLC, and "you" means the person using this website, or the business they act for.

2. Using this website

This website describes the company and what it does. It is free to use and needs no account. By using it you agree to these terms. If you do not agree, please do not use it.

You agree not to:

• use the website for anything unlawful;
• try to gain access to our server or any part of the website that is not meant to be public;
• probe, overload or disrupt the website, or collect its content automatically in a way that puts a load on it;
• present yourself as Gate Wall Studios, or suggest that we endorse you or work with you when we do not.

3. Which terms apply to what

Sealuno

Sealuno, our accounting and invoicing software, is provided under its own Terms of Service, Privacy Policy and Data Processing Agreement, published at sealuno.com. They take precedence over this page for anything about Sealuno, including its prices, trial and billing.

Our games

Our games are distributed through the Apple App Store and Google Play. Buying or downloading a game, and any purchase inside it, is handled by the store under the store's own terms, including its payment and refund rules. A game may come with its own licence terms, shown in its store listing or in the game; where it does not, the licence in this section, these terms and the store's own terms apply.

The games, and everything in them, are licensed to you for your own personal use, not sold.

Software services for business clients

We build and support software for businesses only under a written agreement for each engagement. That agreement sets the scope, price, payment, ownership of the work, warranties and liability, and it takes precedence over these terms. Nothing on this website is an offer to provide services, and describing a service here does not commit us to provide it.

4. Our content and trademarks

The text, design, images and code of this website, and our games, including their code, art and design, belong to Gate Wall Studios LLC, except third-party components, such as the game engine, that we use under licence from their owners. You may view and print pages of this website for your own information. You may not copy, republish or sell its content, or use our images, without our written permission.

Eternal Bastion and the Gate Wall Studios name and logo are trademarks of Gate Wall Studios LLC. Sealuno is our product name. Apple, App Store, Google and Google Play belong to their owners and are mentioned only to say where our games are sold.

5. Links to other websites

This website links to sealuno.com, which we also run under its own terms. It may also mention or link to websites run by others, such as app stores. We are not responsible for websites we do not run, and a link is not an endorsement of them.

6. Information on this website

We try to keep this website accurate and up to date, but it is provided "as is" and for general information only. We do not promise that it is complete, error-free or always available, and descriptions of games or products that are not released yet, including what they will contain and when, may change. Nothing on this website is professional, legal, tax or financial advice.

7. Limits on liability

To the fullest extent the law allows, we are not liable for any indirect or consequential loss, lost profits, lost business or lost data arising from your use of this website.

This website is provided free of charge. Where our liability for it cannot be excluded, our total liability to you for any claim about the website is limited to US$100.

Nothing in these terms limits liability for fraud, or for anything else that cannot lawfully be limited, and nothing takes away rights you have as a consumer that the law says cannot be waived. Our liability for Sealuno, our games and client work is set by the terms that apply to each of them (section 3), not by this section.

8. Privacy

How we handle personal information is explained in our Privacy Policy. In short, this website sets no cookies and runs no tracking.

9. Changes to these terms

We may update these terms as the website and the business change. The new version applies from the date shown at the top of this page, and the date and version there always show the current one. Using the website after a change means you accept the updated terms.

10. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. If we cannot resolve a dispute between us directly, it will be handled in the courts of that state. If you are a consumer in a place whose law gives you additional protections, those protections still apply to you.

Before either of us starts a formal claim, we will each first write to the other and give 30 days to put the problem right. Write to admin@gatewallstudios.com.

If any part of these terms turns out to be unenforceable, the rest stays in force. If we do not enforce a part of these terms straight away, we can still enforce it later.
